When you contact Attorney Terry D. Fisher regarding a possible Chapter 7 or Chapter 13 bankruptcy filing, you can expect to progress through the following steps:

  • In a free initial consultation, we will determine in a preliminary manner your bankruptcy eligibility.
  • You will begin to compile the necessary documents and information from a thorough bankruptcy checklist that I will supply for you.
  • Once you retain my services to act as your bankruptcy attorney, you will be able to refer creditors to my office right away.
  • Once you have compiled all required information and paid your attorneys' fees and filing fees, I will prepare and file your bankruptcy as soon as possible. In some cases, I have filed for people in just a few days. When necessary (such as when foreclosure of your house is imminent), an emergency filing of your case can be accomplished as soon as you have provided copies of all your bills, paystubs and tax returns (four years) and completed a credit counseling course required by the Bankruptcy Code (this can be completed online in a short amount of time).
  • We will prepare for the Section 341 Creditors Meeting. Creditors rarely attend these meetings. Rather, you usually spend a few short minutes answering questions for your trustee and clarifying any questions he or she may have about your Bankruptcy Petition.
  • If you file Chapter 13 bankruptcy, a court-appointed trustee will manage collection of your Plan payments and distribution of payments to your creditors.
  • If you file and are granted a Chapter 7 bankruptcy, most or all of your consumer debts will be discharged. Typically, a discharge is granted 60 days after you complete the Section 341 Creditors Meeting referred to above.
  • Regardless of whether you file Chapter 7 or Chapter 13 bankruptcy, some debts will not be discharged or reduced. They include most past due taxes; child support arrears and student loans.
