The question of eligibility is a key concern to someone contemplating filing Chapter 7 bankruptcy. Chapter 7 is often called a "straight bankruptcy." In reality, most consumers who do qualify for Chapter 7 bankruptcy end up not having to liquidate anything. The Bankruptcy Code allows debtors to "exempt" certain property necessary for the debtor to have a "fresh start." Exempt property is property the bankruptcy trustee cannot take and liquidate to pay creditors. The vast majority of bankruptcy debtors are able to exempt all of their property, including equity in their home, their car, their pension, 401(k), IRA or other retirement accounts, and their household goods and other property.

That's right — most people who file Chapter 7 bankruptcy do not have to sell or lose anything. A Chapter 7 brings a clean slate, a fresh start — elimination of consumer debts. Taking proper advantage of the clean slate is very important, since once you file Chapter 7 bankruptcy, you will not be able to file Chapter 7 bankruptcy again for eight years.
